Legal? HOW THE JOB SUPPORT SCHEME WORKS WHEN PUBS ARE CLOSED (“JSS CLOSED”)9. You will be placed on the JSS Closed if your pub has been closed as a result of national or local lockdown and as a result there is no work for you to do. You will be placed on the JSS Closed for a minimum of seven consecutive calendar days.10. While on the JSS Closed, then, subject to meeting the relevant eligibility criteria, you will be paid two thirds of your normal pay, up to the cap of a £2,083.33 month.11. We will be using the Job Support Scheme to reclaim that two-thirds of your pay from the government.SECTION 3JOB SUPPORT SCHEME RULES12. If, for any reason, HMRC decides not to pay us (or decides to reclaim from us) any monies in connection with your pay or salary, we are entitled to: not pay it to you, despite what this agreement says; or, if we have already paid it to you we shall be entitled to reclaim it from you and to deductit from any pay or salary or other payments due to you at any time.13. If anything in this agreement is contrary to any guidance or practice of HMRC under the Job Support Scheme, then the terms of the Job Support Scheme shall take precedence.14. Deductions for tax, national insurance and pension contributions will continue to be made from all pay and salary payments, and we will continue to make pension contributions in the normal way.15. If we bring you back from the Job Support Scheme to work your normal contractual working hours, we retain the right to return you to the Job Support Scheme at any point.16. If you become unwell, our sickness absence policy will apply. If you are required to self-isolate on medical or government advice (including test, track and trace) due to risk of infection with Covid- 19, you will be entitled to SSP. You may also be entitled to Company Sick Pay and you may wish to ask us to use any accrued annual leave as a way of topping up your pay.17. You can take, and we can require you to take, annual leave whilst on the Job Support Scheme, and our annual leave policy will apply. On each day that you take annual leave you will be paid your normal pay or salary.18. We may make changes to this agreement, by giving you 24 hours’ notice in writing (including by email or e-shot), if changes are reasonably required t(a) to ensure compliance with the government’s Job Support Scheme, or (b) to bring this agreement into line with any amendments to the Job Support Scheme or guidance issued by the government.19. This agreement ends when the government’s Job Support Scheme closes (expected to be 30 April 2021) or earlier if we decide to stop using the Job Support Scheme.
